DYE WILL
State of Texas
Collin County
Conscious of the uncertainty of life and the certainty of death, and being of Sound memory and discretion, I Henry Dye of the town of Plano Collin County Texas do make this my last will and testament.
I give and devise and bequeath my estate and property real and personal as follows, that is to say
Item 1: I give and bequeath to my beloved wife Sarah E. Dye for and during her natural lifetime a sufficiency from and out of the rents and profits of my homestead to meet the reasonable demand for her support and sustenance. Said homestead consisting of two hundred and twenty acres out of the James Beverly tract of land and twelve and a half acres out of the Joseph Klepper Survey also a tract of timber land on Rowlets Creek deeded to me by Stephen H. Shrader containing 16 2/3 acres. And it is my will that my said wife shall have and keep with her on said homestead all of our minor children during their minority and it is my will further that my hereinafter named executors shall use and appropriate all that may be necessary of the rents and profits of my said homestead for the support and education of all of our said minor children and the support of my wife as aforesaid – I do further give bequeath and devise all of said homestead after the death of my wife to all of my children in equal portions to be partitioned as soon after the death of my wife as shall be deemed by my executors expedient.
Item 2: I give and bequeath to my wife Sarah E. Dye all that may be necessary of my farming implements tools and stock for the carrying on and cultivating of said homestead.
And it is my will that my executors sell and dispose of at public outcry on terms to them seeming best all stock and farming implements not necessary to carry on and cultivate said homestead and collect all notes and accounts due me at my death and to apply the proceeds of such sales and collections to the discharge of my just and lawful debts. It is my will further that my executors shall sell and dispose of at public outcry my professional library and surgical instruments and likewise apply the proceeds of said sale towards the payment of my just and lawful debts.
Item 3: I give and bequeath the residue of my insurance on Policy Number 52415 in Phoenix Mutual Life Insurance Company, after discharging all my just and lawful debts to my executors to be held by them and expended for the support of my wife and support and education of my minor children and I further will that my said Executors have control of said money collected on said policy and do empower them to invest or loan the same on good security and so far as possible use only the interest for the support of my wife and support and education of my minor children and that keeping up and properly protecting said homestead – After the youngest of my children shall have arrived at the age of majority — I give and bequeath whatever may be left of said money equally to my children.
Item 4: I do give bequeath and devise unto all my children in equal portions all my real estate of which I may die seized except the homestead mentioned in Item 1 and it is my will that my Executors partition the said Real Estate as equally among all my children as soon as practicable after my death and I do empower my said executors to select choose and appoint three commissioners in each county wherein any of said land may be located who shall partition said land among my children as herein authorized, be all that may be required for the final and full settlement between my heirs of their respective interests so far as proceedings in court are concerned.
Item 5: I do appoint J. H. Bowman and G. W. Bowman of Plano in Collin Texas Executors of this my last will and testament and I further will that the court shall have no further jurisdiction of the matters of my Estate than the probating of this my last will and testament approving bond and receiving inventory.
In witness whereof I have signed sealed using scroll for seal and declared this instrument as my will at Plano Collin County Texas on the 3rd day of April 1876.

And now comes Joseph Forman into open court and being duly sworn says that heretofore to wit April 3rd A. D. 1876 he was present at the residence of Henry Dye when he the said Dye signed the will now on file among the papers in said Dye’s estate that he and P. T. Smith and J. K. Aldridge signed the same as attesting witnesses at the request of the said Dye.

D. 1876 in the presents of Peter T. Smith, Joe Forman and Jas. R. Aldridge, that is to Say that I will to my daughter Euphema P. Dye My pianos which Piano is now at my Fathers in the Town of Plano in Collins County and that She the said Euphema My daughter is to exercise full control and ownership over the same.
